Terms of Use

Last updated

These terms govern your use of digitalshieldernex.com. By browsing the site you accept them. If you do not accept them, please stop using the site.

1. Who you are dealing with

This website is operated by Digital Shielder Nex LLC, 200 Congress Ave, Suite 400, Austin, TX 78701, United States (“we”, “us”). References to “the site” mean digitalshieldernex.com and everything published on it.

2. What this site is

The site publishes general informational articles about Windows PC performance and maintenance, alongside advertising for third-party software. It is a publication, not a service. We do not diagnose, repair or optimise computers, and we do not develop or sell the software described here.

3. The content is general, not advice for your machine

Everything on this site is written for a general audience. It is not technical advice tailored to your computer, and it should not be treated as a substitute for a qualified technician where one is needed. No page on this site examines your device or reports findings about it. Outcomes described here are typical, not promised: what actually happens depends on your hardware, its age, its configuration and how it has been used.

Before making changes to a computer — deleting files, editing the registry, removing start-up entries or installing maintenance software — back up anything you cannot afford to lose. You act on your own judgement and at your own risk.

4. Advertising and affiliate relationships

The site is funded by advertising and affiliate commissions. Pages that recommend a product are advertising, and are marked as such. If you follow a link and download or purchase, we may be paid a commission by the vendor; your price is unaffected. This relationship influences which products appear on the site. Full details are in our Disclaimer.

5. Third-party sites and software

Outbound links take you to sites we do not control. We are not responsible for their content, their availability, their pricing, their privacy practices or the software they distribute. Any purchase, licence, subscription, renewal, refund or support matter is a contract between you and that vendor, on their terms — not ours. Read the vendor's licence agreement, pricing and cancellation terms before you buy anything.

In short: we introduce you to a product. We are not a party to the transaction that follows, and we cannot access, change, refund or cancel it. The vendor's support desk is the right place for those requests.

6. Permitted use

You may read, print and share our pages for your own personal, non-commercial use. You may not:

  • republish, sell or systematically copy our content without written permission;
  • scrape, crawl or harvest the site by automated means beyond ordinary search-engine indexing;
  • attempt to gain unauthorised access to the site or any server or account connected to it;
  • interfere with the site's operation, security or availability;
  • use the site for anything unlawful, or in any way that misrepresents your relationship with us.

7. Intellectual property

The text, layout, design, code and graphics on this site, and the Digital Shielder Nex name and logo, are owned by Digital Shielder Nex LLC or used under licence. Third-party names, logos and trademarks — including Microsoft, Windows and the names of the software products discussed — belong to their respective owners and are used for identification only. Their use here does not imply any affiliation with, sponsorship by or endorsement from those owners.

8. Availability

We make no promise that the site will be available without interruption or free from errors. We may change, suspend or withdraw any part of it, and may revise the content at any time without notice.

9. Disclaimer of warranties

To the fullest extent permitted by law, the site and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the information here is complete, current or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Digital Shielder Nex LLC, its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, goodwill or system availability, arising out of or in connection with your use of the site, your reliance on its content, or any third-party product or website reached from it. Nothing in these terms excludes any liability that cannot lawfully be excluded.

11. Indemnity

You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your misuse of the site.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law rules. The state and federal courts located in Travis County, Texas, will have exclusive jurisdiction over any dispute, save that consumers may retain the right to bring proceedings in the courts of their country of residence where local law provides for that.

13. Changes to these terms

We may revise these terms. The version published on this page at the time you use the site is the version that applies, so please check the date above from time to time.

14. Contact

Questions about these terms can be sent to hello@digitalshieldernex.com or to the postal address given on our Contact page.
